General Terms and Conditions for participation in the "Rivers of Sofia" Competition

I.Subject

Article 1. (1) These General Terms and Conditions govern the relationship between The Collective Foundation, VAT number 206066308, with registered office and management address: Sofia, Lyulin District, Lyulin 7 Housing Estate, Block 724, Entrance B, Floor 1, Apartment 3 (hereafter referred to as the “Organiser”) and the participants in the “Rivers of Sofia” Competition (hereafter referred to as the “Competition”).

(2) The Organiser is the creator of the initiative “Rivers of the City”, which aims to reconnect neighbourhoods with urban rivers through art and architectural installations. The organiser amplifies the voice of urban rivers, organises the Rivers of Sofia Festival, and initiates public space improvement projects, demonstrating the potential of rivers for urban life. 

(3) The Competition is implemented under the “Festivals” program of the National Culture Fund of Bulgaria.

Article 2. (1) These Terms and Conditions apply to all Competition participants. Any person residing in Bulgaria who has explicitly accepted these Terms and Conditions and has submitted a competition project is eligible to participate. Once a person acquires participant status, a contractual relationship is established between the Organiser and the participant under these terms and conditions.

(2 ) The Organiser publishes these Terms and Conditions on the website www.kolektiv.bg/terms-and-conditions-rivers-of-sofia and reserves the right to unilaterally amend and supplement them. Participants will be notified of any changes via publication on the website kolektiv.bg before they take effect.

(3) Within three days of publication of any amendments, participants who have already applied to the Competition may submit a written objection via email to competitions@kolektiv.bg. If an objection is submitted, the contractual relationship between the Organizser and the participant is terminated, and the participant’s involvement in the competition is canceled.

(4) If a Competition participant is under 18, their submission must be accompanied by written consent from a parent or legal guardian. This consent must be documented in a signed declaration, a copy of which should be sent to competitions@kolektiv.bg. The declaration must include: 

  • The full name of the consenting parent/guardian.
  • Their relation to the participant (parent or legal guardian).
  • The following statement: As the parent/guardian of [participant’s name], I give my consent for their participation in the Rivers of Sofia Competition and confirm that we have read and agree to the terms and conditions of participation.

The Organiser is not responsible for verifying the authenticity of the declaration or the accuracy of its contents.

II. Participation Requirements and Evaluation Criteria

Article 3. (1) Participation in the Competition requires the creation and submission of a proposal for a sculpture or another artistic installation to be exhibited at the Rivers of Sofia Festival in South Park, Sofia, from 29 to 31 August 2025.

(2) The selected artists are responsible for ensuring that their works are completed and installed on-site by August 28, 2025. All installations must be dismantled and removed by their creators within one day after the festival ends. Installations must not obstruct visitor movement or damage the existing infrastructure and park environment.

(3) The Competition focuses on the following themes:

  1. River ecosystem – illustrating rivers as vital ecological corridors that support biodiversity and provide essential resources for urban life. The aim is to capture the life-giving nature of rivers and their role in uniting people and nature within urban ecosystems.
  2. Social and cultural rivers – highlighting rivers as lifelines within cities which foster social connections and cultural exchange. The focus is on rivers as public spaces for community, leisure, and culture.
  3. Historical significance – exploring how rivers have shaped past and present cityscapes. The goal is to rediscover historical transformations and their relevance to the future of urban environments.

(4) The scope of the Competition is not limited to Article 3, paragraph 3, and participants may address other topics through their works, including, but not limited to, the idea of beauty (or the lack thereof) in and around rivers. Competition projects may also include aspects of the diverse flora and fauna found along riverbanks and underwater, as well as possible improvements in biodiversity, public access, flood and drought issues, cultural heritage preservation, and more. Participants are free to propose their own original interpretation of the competition themes.

(5) Participants in the Competition apply to one of the following two categories:

  • Established artists: Participants with proven experience in similar competitions or in the field of visual arts in general.
  • Young artists: Participants who have graduated in a visual arts discipline in 2023 or later. In exceptional cases, applications from younger participants who have not yet completed their artistic education will also be considered.

Article 4. (1) Participants submit their projects for the Competition by uploading them to the Competition page on the website kolektiv.bg, along with the following information:

  1. About the participant:
  • Name and Surname
  • Email address
  • Phone number
  • Age
  • Category they are applying for: Young artists or Established artists
  • Education (institution, major, year of graduation)
  • Professional experience
  • Link (website or social media)
  • Portfolio of completed projects (for the Established Artists category) – at least 5 projects with descriptions and visual materials
  • Motivational letter (for the Young Artists category), explaining how participating in the festival will contribute to their development

б. About the artwork:

  • Title of the artwork
  • Lead image representing the artwork, with dimensions 1080 x 1350 px, in JPEG or PNG format
  • Album – A3 size in PDF format (up to 50 MB), including visualisations, sketches, and a map indicating the location for positioning the installation within the festival area.
  • Explanatory note (up to 2 pages), describing the artwork, its message, the materials used, and its connection to the festival’s theme. The note may also include a proposed accompanying program of at least two events related to the artwork.

(2) Along with submitting their competition projects, participants must also include the following statement: “I confirm that I have read and agree to the Terms and Conditions for participation in the Rivers of Sofia Competition.”

(3) The right to participate in the Competition is activated with the official announcement on 15 March 15 2025. The deadline for submitting competition projects is 13 May 13 2025. The five selected artworks for the Rivers of Sofia festival will be announced on 4 June 4 2025. The festival itself will take place on 29-31 August 2025.

(4) The competition projects will be evaluated by a jury composed of representatives of the Collective Foundation and external experts.

(5) The jury evaluates the competition projects based on the following criteria:

  1. For established artists:
  • Concept of the proposed installation:
  • Uniqueness, innovation, and impact (20%)
  • Relevance to the festival theme (20%)
  • Experience and completed projects:
    • Portfolio of visual works (30%)
    • Works related to ecology, nature, or urban space (10%)
  • Technical execution: A realistic and feasible plan for materials, production, and installation, as well as the sustainability of the materials used (20%).
  1. For young artists:
  • Concept of the proposed installation:
    • Uniqueness, innovation, and impact (25%)
    • Relevance to the festival theme (25%)
  • Potential for development: Motivation and how the proposed work aligns with the artist’s future vision (30%)
  • Technical feasibility of the project: Practical applicability of the proposed installation, despite the artist’s limited experience (20%).

(2) The five selected projects will be executed by the authors and displayed during the Rivers of Sofia festival 2025.

Article 6. (1) Participants agree to voluntarily take part in the Competition. No reward or compensation is owed for participation in the Competition. Participants accept all the difficulties, risks, and inconveniences associated with their participation in the Competition and take responsibility for all costs and expenses related to their participation and the fulfilment of the obligations outlined in these Terms and Conditions.

(2) Participation in the Competition does not guarantee the participant will win a prize or have their work executed or exhibited.

(3) Participants agree to follow the Organiser’s instructions regarding their participation in the Competition and the fulfillment of their obligations under these Terms and Conditions.

(4) The Organiser independently determines the rules for selecting participants who will win the individual prizes in the Competition. The decision on the winning participants is final and is not not subject to dispute or revision.

(5) Participants acknowledge that even if they are included in the Competition, the Organiser is not obligated to declare a winner if they determine that none of the submitted projects meet the requirements outlined in the brief.

Article 7. Participants provide true and accurate personal data, information, and declarations (when such are required) for their participation in the Competition. In case the provided personal data, information, or declarations are false and/or the participant fails to comply with any of the clauses of these Terms and Conditions, the Organiser has the right to disqualify/remove them from participation in the Competition and/or from any prize in the Competition, if applicable.

Article 8. The Organiser has the right to make public statements, explanations, and announcements as deemed appropriate regarding the fulfillment or non-fulfillment of the Terms and Conditions by participants and/or the regulations and rules of the Competition.

III. Assignment of Rights for the Use of Protected Works under the Copyright and Related Rights Act (ZAPSP) in Favor of the Organiser

Article 9. (1) As part of the conditions for participation in the Competition, participants grant the Organiser the rights to one or more works – competition projects with specific authorship content.

(2) Depending on the nature of the use and at the discretion of the Organiser, the author may be explicitly credited when a specific work is used. No payment or compensation is due to the participant for the use of the competition projects by the Organiser under these rules or in any manner during the Competition.

Article 10. (1) The participant undertakes, declares, and guarantees that:

  • The participant is the author of the competition project or has obtained consent from the author of the work for its publication and participation in the Competition in accordance with these General Terms, and that the author of the work has given consent for the transfer of rights to the Organiser as per Article 9. The participant is obligated to inform the Organiser of the author of the work if it is a third party, different from the participant;
  • The work does not contain violence and does not violate human dignity, or affect in any way the privacy or the sanctity of private or family life of any person, and does not harm the rights or good name of others;
  • The work does not contain pornographic content;
  • The work does not contain religious and/or political propaganda;
  • The work does not violate the rights and legitimate interests of third parties, including copyright, dignity, public reputation, good name, and others;
  • The work does not incite hatred based on race, gender, religion, or nationality, and does not contain any form of discrimination or abuse of trust;
  • The work does not endanger the physical, mental, or moral development of minors and young people;
  • The use of the work and its content do not violate applicable laws, these General Terms, moral rules, or good practices;
  • The work does not contain advertising materials or messages.

(2) In the event of a violation, the participant assumes full responsibility and pays any compensation imposed by a competent authority to the affected parties, as well as fines and property sanctions, as well as any amounts that the Organiser may be required or has agreed to pay as compensation to a third party, along with any damages and expenses incurred by the Organiser.

IV. Rules for Participation

Article 11. By accepting these Terms and Conditions, the participant declares that there is no contract or other agreement between them and any third party that would prevent the fulfillment of these Terms and Conditions, and that the participant will not undertake any obligations that would hinder the fulfillment of these Terms and Conditions.

Article 12. Participants are responsible to uphold the reputation of the Organiser and its partners, including the National Culture Fund of Bulgaria, and they must not hinder or stop the Competition, its promotion, or advertisement in any way.

Article 13. (1) Each participant has the right to request information from the Organiser regarding the Competition and its conditions.

(2) Each participant has the right to notify the Organiser of any issues they have identified related to the use of the website or the application page (including identified errors, technical difficulties, violations of rights, etc.) and other technical issues during participation in the Competition.

(3) Each participant has the right to withdraw from the Competition by submitting a written statement to the Organiser. The withdrawal will not affect the legality of actions taken by the Organiser up until the date of withdrawal.

Article 14. (1) When using the website or the application page for the purposes of the Competition, participants are obligated not to violate the rights and interests of the Organiser and third parties and not to engage in malicious actions.

(2) “Malicious actions,” for the purposes of these Terms and Conditions, refer to actions or omissions that lead to the unauthorised use or modification of the Rivers of Sofia Competition page or the website kolektiv.bg, and/or the content of the website or page. Malicious actions may include, but are not limited to, modifying content, posting materials on the site, unauthorized data collection, breaching security or maliciously exploiting system weaknesses (HACK), damaging or destroying systems or data arrays, software functions and features (CRACK), sending “Trojan horses” or triggering the installation of viruses or remote control systems, sending spam, flooding channels, bypassing, damaging, or otherwise disrupting the normal operation of technical or software applications, and any other actions that disrupt the normal functioning of the site and the ability of other users to use the site, as well as any actions that may be considered illegal under Bulgarian legislation.

(3) Participants are obligated not to perform any actions that could manipulate the selection process or the outcome of the selection for the Competition, or could hinder the Competition proceedings.

Article 15. Each participant is responsible in case of violation of these Terms and Conditions and any breach of applicable legislation related to the Competition, and is obligated to indemnify the Organiser for all damages – incurred losses and missed profits resulting from the violation, including paid fines, legal fees, and other expenses arising from claims made by and/or compensation or remuneration paid to third parties.

V. Protection of personal data

Article 16. (1) In connection with their participation in the Competition, each participant voluntarily provides the Organiser with the following personal data: first name, last name, age, place of residence, country, phone number, email address, and others. For participants under 18 years of age, the data of parents/guardians/custodians is also provided, including the name and surname of the person giving consent, as well as their capacity (parent or guardian/custodian) in relation to the participant.

(2) The Organiser (identified in Article 1 of the Terms and Conditions) is the data controller for the personal data provided in paragraph 1 of this article.

(3) The personal data specified in paragraph 1 will be processed (used) by the Organiser for the purposes of conducting the Rivers of Sofia Competition.

Article 17. Personal data is provided voluntarily by the participants, based on the contractual relationship between the Organiser and the participants under these Terms and Conditions. If a participant does not provide their personal data or part of it, this may result in the impossibility of their participation in the Competition.

VI. Limitation of liability

Article 18. (1) The Organiser is not responsible for:

  • Inability to access the website kolektiv.bg or malfunctioning of the site, including technical reasons resulting from the Organiser’s testing of technical resources and software, connections, networks, and others, as well as any other checks or work on the site aimed at improving or reworking the site and/or its content;
  • The functioning of the internet network and the Competition page, and the connection with the users’ and participants’ devices;
  • The potential presence of “viruses” or other harmful effects from using the site;
  • Malicious actions by users, participants, or third parties;
  • Any actions or inactions by users or third parties, unavailability or malfunctioning of internet connectivity, or any other reason leading to degraded quality or inability to use the websites or page uninterruptedly, including, but not limited to, improper handling of equipment by users or third parties, failure of third parties or users to fulfill their obligations in relation to the use of the site, force majeure circumstances, and others.

(2) The Organiser is not responsible for any damage caused to the user’s software, hardware, or equipment, or for the loss of data arising from materials or resources searched, uploaded, or used in any way through the services provided on the website or the page.

(3) The Organiser is not liable to the participants or users of the website or page for any damages or lost profits resulting from the termination, suspension, restriction of access, or modification of the website www.kolektiv.bg or the Competition page, or the resources or services on the site, or as a result of deletion, modification, or loss of materials or information accessible through the website or the page.

VII. Other

Article 20. For all matters not regulated by this agreement, the provisions of the applicable legislation of the Republic of Bulgaria shall apply.

Article 21. All disputes between the parties shall be resolved in the spirit of understanding and goodwill. If no agreement is reached, all unresolved disputes arising from the application of these Terms and Conditions, including their interpretation, validity, and execution, will be resolved by the competent court in Sofia, in accordance with the applicable Bulgarian legislation.

Article 22. These Terms and Conditions are effective from March 15, 2025.
