Article 1. (1) These General Terms and Conditions govern the relationship between The Collective Foundation, VAT number 206066308, with registered office and management address: Sofia, Lyulin District, Lyulin 7 Housing Estate, Block 724, Entrance B, Floor 1, Apartment 3 (hereafter referred to as the “Organiser”) and the participants in the “Rivers of the Past” Competition (hereafter referred to as the “Competition”).
(2) The Organiser is the creator of the initiative “Rivers of the City”, which aims to reconnect neighbourhoods with urban rivers through art and architectural installations. The organiser amplifies the voice of urban rivers, organises the Rivers of Sofia Festival, and initiates public space improvement projects, demonstrating the potential of rivers for urban life.
(3) The Competition is carried out under the project “Transformative Urbanism – Restoring the Connection Between People and the Yantra River,” organized in partnership with the organization TaM, the 48 Hours Varusha South festival, the EUNIC Cluster Bulgaria, and 9 partner institutions.
Article 2. (1) These Terms and Conditions apply to all Competition participants. A participant in the Competition may be any person residing in the European Union (including Ukraine, Serbia, and North Macedonia) who has explicitly accepted these Terms and Conditions and submitted their competition project. Once a person acquires participant status, a contractual relationship is established between the Organiser and the participant under these terms and conditions.
(2 ) The Organiser publishes these Terms and Conditions on the website www.kolektiv.bg and reserves the right to unilaterally amend and supplement them. Participants will be notified of any changes via publication on the website kolektiv.bg before they come into effect.
(3) Within three days of publication of any amendments, participants who have already applied to the Competition may submit a written objection via email to competitions@kolektiv.bg. If an objection is submitted, the contractual relationship between the Organizer and the participant is terminated, and the participant’s involvement in the competition is also terminated.
(4) If a Competition participant is under 18, their submission must be accompanied by written consent from a parent or legal guardian. This consent must be documented in a signed declaration, a copy of which should be sent to competitions@kolektiv.bg. The declaration must include:
The Organiser is not responsible for the authenticity of the submitted declaration nor for the accuracy of the provided statement.
Article 3. (1) Participation in the Competition requires the creation and submission of an artwork – a poster – which will be displayed in a temporary open-air gallery as part of the “48 Hours Varusha south” festival in Veliko Tarnovo, taking place from August 15 to 17, 2025.

(3) Projects may focus on either distant or recent history, showcasing the interaction between people and rivers. We expect visual interpretations that tell stories, evoke memories, or offer a new perspective on the role of rivers in people’s lives.
Article 4. (1) Participants submit their projects for the Competition by uploading them to the Competition page on the website kolektiv.bg, along with the following information:
(2) Along with submitting their competition projects, participants must also include the following statement: “I confirm that I have read and agree to the Terms and Conditions for participation in the Rivers of the past Competition.”
(3) The right to participate in the Competition is activated with the official announcement of the open call on April 25, 2025. The deadline for submitting competition projects is June 2, 2025. The announcement of the twelve selected works for the “48 Hours Varusha south” festival exhibition will take place on June 30, 2025. Public voting on social media for the Audience Award will be open from June 30 to July 30. The exhibition at the “48 Hours Varusha south” festival will take place from August 15 to 17, 2025. The award ceremony will be held on August 16, 2025.
(4) The competition projects will be evaluated by a jury composed of representatives from “TaM”, “The Collective”, “EUNIC”, and youth from the “Design by Yantra” team.

(6) The twelve selected projects will be displayed in an outdoor gallery during the “48 Hours Varusha South” 2025 festival.
Article 5. (1) Participants agree to voluntarily take part in the Competition. No reward or compensation is owed for participation in the Competition. Participants accept all the difficulties, risks, and inconveniences associated with their participation in the Competition and take responsibility for all costs and expenses related to their participation and the fulfilment of the obligations outlined in these Terms and Conditions.
(2) Participation in the Competition does not guarantee the participant will win a prize or have their work executed or exhibited.
(3) Participants agree to follow the Organiser’s instructions regarding their participation in the Competition and the fulfillment of their obligations under these Terms and Conditions.
(4) The Organiser independently determines the rules for selecting participants who will win the individual prizes in the Competition. The decision on the winning participants is final and is not not subject to dispute or revision.
(5) Participants acknowledge that even if they are included in the Competition, the Organiser is not obligated to declare a winner if they determine that none of the submitted projects meet the requirements outlined in the brief.
Article 6. Participants must provide true and accurate personal data, information, and declarations (when such are required) for their participation in the Competition. In case the provided personal data, information, or declarations are false and/or the participant fails to comply with any of the clauses of these Terms and Conditions, the Organiser has the right to disqualify/remove them from participation in the Competition and/or from any prize in the Competition, if applicable.
Article 7. The Organiser has the right to make public statements, explanations, and announcements as deemed appropriate regarding the fulfillment or non-fulfillment of the Terms and Conditions by participants and/or the regulations and rules of the Competition.
Article 8. (1) As a condition of participation in the Competition, each participant publishes or provides for publication on the website one or more works—competition projects with specific copyrighted content.
(2) By accepting these General Terms and Conditions and by submitting/providing their competition project, participants agree to assign to the Organizer all proprietary and transferable non-proprietary copyright rights to the submitted competition project. Participants also grant the Organizer the exclusive right to use the projects repeatedly in any manner permitted by the Copyright and Related Rights Act (CRRA), for the maximum permissible duration defined by the CRRA, and worldwide.
(3) The usage referred to in the previous paragraph includes, but is not limited to: reproduction, distribution, publication (including on the internet—e.g., websites and social networks), public display, adaptation or use in any other manner, analog and digital distribution, content transmission via mobile networks, internet and other distribution platforms, storage in the site’s archive and database, and the right to sublicense the usage rights under this paragraph to third parties.
(4) Depending on the nature of the use and at the discretion of the Organizer, the author may be explicitly credited when a specific work is used. No remuneration is due to the participant for the use of competition projects by the Organizer and its partner Visa in the context of this Competition or in any other form as described in these rules. By participating in the Competition, the participant is given the opportunity to promote their work via the Organizer’s website and the Competition page, within the framework and under the conditions of the Competition and these General Terms and Conditions.
Article 9. (1) The participant undertakes, declares, and guarantees that:
(2) In the event of a violation, the participant assumes full responsibility and pays any compensation imposed by a competent authority to the affected parties, as well as fines and property sanctions, as well as any amounts that the Organiser may be required or has agreed to pay as compensation to a third party, along with any damages and expenses incurred by the Organiser.
Article 10. By accepting these Terms and Conditions, the participant declares that there is no contract or other agreement between them and any third party that would prevent the fulfillment of these Terms and Conditions, and that the participant will not undertake any obligations that would hinder the fulfillment of these Terms and Conditions.
Article 11. Participants are responsible to uphold the reputation of the Organiser and its partners, including the National Culture Fund of Bulgaria, and they must not hinder or stop the Competition, its promotion, or advertisement in any way.
Article 12. (1) Each participant has the right to request information from the Organiser regarding the Competition and its conditions.
(2) Each participant has the right to notify the Organiser of any issues they have identified related to the use of the website or the application page (including identified errors, technical difficulties, violations of rights, etc.) and other technical issues during participation in the Competition.
(3) Each participant has the right to withdraw from the Competition by submitting a written statement to the Organiser. The withdrawal will not affect the legality of actions taken by the Organiser up until the date of withdrawal.
Article 13. (1) When using the website or the application page for the purposes of the Competition, participants are obligated not to violate the rights and interests of the Organiser and third parties and not to engage in malicious actions.
(2) “Malicious actions,” for the purposes of these Terms and Conditions, refer to actions or omissions that lead to the unauthorised use or modification of the Rivers of Sofia Competition page or the website kolektiv.bg, and/or the content of the website or page. Malicious actions may include, but are not limited to, modifying content, posting materials on the site, unauthorized data collection, breaching security or maliciously exploiting system weaknesses (HACK), damaging or destroying systems or data arrays, software functions and features (CRACK), sending “Trojan horses” or triggering the installation of viruses or remote control systems, sending spam, flooding channels, bypassing, damaging, or otherwise disrupting the normal operation of technical or software applications, and any other actions that disrupt the normal functioning of the site and the ability of other users to use the site, as well as any actions that may be considered illegal under Bulgarian legislation.
(3) Participants are obligated not to perform any actions that could manipulate the selection process or the outcome of the selection for the Competition, or could hinder the Competition proceedings.
Article 14. Each participant is responsible in case of violation of these Terms and Conditions and any breach of applicable legislation related to the Competition, and is obligated to indemnify the Organiser for all damages – incurred losses and missed profits resulting from the violation, including paid fines, legal fees, and other expenses arising from claims made by and/or compensation or remuneration paid to third parties.
Article 15. (1) In connection with their participation in the Competition, each participant voluntarily provides the Organiser with the following personal data: first name, last name, age, place of residence, country, phone number, email address, and others. For participants under 18 years of age, the data of parents/guardians/custodians is also provided, including the name and surname of the person giving consent, as well as their capacity (parent or guardian/custodian) in relation to the participant.
(2) The Organiser (identified in Article 1 of the Terms and Conditions) is the data controller for the personal data provided in paragraph 1 of this article.
(3) The personal data specified in paragraph 1 will be processed (used) by the Organiser for the purposes of conducting the Rivers of Sofia Competition.
Article 16. Personal data is provided voluntarily by the participants, based on the contractual relationship between the Organiser and the participants under these Terms and Conditions. If a participant does not provide their personal data or part of it, this may result in the impossibility of their participation in the Competition
Article 17. (1) The Organiser is not responsible for:
(2) The Organiser is not responsible for any damage caused to the user’s software, hardware, or equipment, or for the loss of data arising from materials or resources searched, uploaded, or used in any way through the services provided on the website or the page.
(3) The Organiser is not liable to the participants or users of the website or page for any damages or lost profits resulting from the termination, suspension, restriction of access, or modification of the website www.kolektiv.bg or the Competition page, or the resources or services on the site, or as a result of deletion, modification, or loss of materials or information accessible through the website or the page.
Article 18. For all matters not regulated by this agreement, the provisions of the applicable legislation of the Republic of Bulgaria shall apply.
Article 19. All disputes between the parties shall be resolved in the spirit of understanding and goodwill. If no agreement is reached, all unresolved disputes arising from the application of these Terms and Conditions, including their interpretation, validity, and execution, will be resolved by the competent court in Sofia, in accordance with the applicable Bulgarian legislation.
Article 20. These Terms and Conditions are effective as of April 25, 2025.
