General terms and conditions for participation in the competition "Rivers of the Future”

I. Subject

Article 1. (1) These General Terms and Conditions govern the relationship between The Collective Foundation, VAT number 206066308, with registered office and management address: Sofia, Lyulin District, Lyulin 7 Housing Estate, Block 724, Entrance B, Floor 1, Apartment 3, in cooperation with Poiema Collective Foundation, VAT number 206275795, with registered office and management address: Sofia, Triaditsa District, Gotse Delchev Housing Estate, Block 235, Entrance B, Floor 3, Apartment 27 (hereinafter referred to as the “Organizer”) and the participants in the “Rivers of the Future” competition (hereinafter referred to as the “Competition”).

(2) The Organizer is the creator of the “Rivers of the City” initiative, which works to reconnect neighborhoods with urban rivers through art and architectural installations. The Organizer gives voice to urban rivers, organizes the “Rivers of the City” festival, and prepares initiatives to improve public spaces, demonstrating the potential of rivers for people’s lives. The Organizer expands its initiative in Europe through the network of national institutes for culture of the EU (EUNIC).

(3) The competition is organized in partnership with Visa, who finance an exhibition of 12 selected works, as well as provide cash prizes for 3 winners and fund travel to Sofia, Bulgaria, for the “Rivers of Sofia” festival on August 30, 2024. Visa emphasizes the importance of sustainable urban development by partnering with urban transport agencies to implement over 600 projects worldwide that facilitate sustainable mobility through contactless billing and payment solutions for transport services. Additionally, Visa collaborates with various stakeholders to support innovation in smart cities, promoting the growth of urban environments that are both economically vibrant and environmentally sustainable.

Article 2. (1) These General Terms and Conditions apply to all participants in the Competition. Any person residing in any EU country, Ukraine, Serbia, and North Macedonia who has explicitly accepted the General Terms and Conditions and has submitted their competition project – a poster for the “Rivers of the City” 2050 festival can participate in the Competition. Upon acquiring the status of a participant in the Competition, a contractual relationship governed by these General Terms and Conditions arises between the Organizer and the participant.

(2) The Organizer publishes these General Terms and Conditions on the website www.kolektiv.bg/competitions, the homepage, or a subpage of the website (together and separately below referred to as the “website”), as well as on the Competition page “Rivers of the Future”. The Organizer has the right to unilaterally amend and supplement the General Terms and Conditions, and when making such a change, notifies all participants in the Competition of the changes and additions by publishing the amended General Terms and Conditions on the website www.kolektiv.bg/competitions and on the Competition page “Rivers of the Future” before they enter into force.

(3) Within a period of up to three days from the date of publication of the respective amendment to the General Terms and Conditions, any participant who has declared their participation before the amendment has the right to make a written objection to the Organizer in case of disagreement, by sending a message to the following email address competitions@kolektiv.bg.  Upon filing an objection, the contractual relationship between the participant and the Organizer is terminated, and participation in the Competition is also terminated.

(4) In the event that there is a participant in the Competition who has not reached the age of 18, the submission of a competition project can only be made with the consent of a parent exercising parental rights or a guardian. The consent of the parent/guardian is certified by a written declaration, a copy of which should be sent to the Organizer at the following email address competitions@kolektiv.bg. The declaration from the parent/guardian should contain the name and surname of the person giving the consent, in what capacity (parent or guardian) they are regarding the participant, as well as the following content: “In my capacity as a parent/guardian of ……………….. (the name of the participant is indicated), I give my consent for them to participate in the “Rivers of the Future” Competition, confirming that we have read and agree to the General Terms and Conditions for participation in the Competition and the Rules for processing and protecting personal data of the Competition.” The Organizer is not responsible for the authenticity of the submitted declaration or the accuracy of the expressed will.

II. Requirements for Participation and Evaluation of Participants

Article 3. (1)Participation in the Competition is associated with the creation and presentation of a competition project – a poster for the “Rivers of the City” 2050 festival. The location for the futuristic festival can be an existing river – local, distant, or imaginary, with abstract or realistic content according to the participant’s vision.

(2)The competition project – poster can be created as an illustration, text, photograph, collage, architectural rendering, or mixed media, as well as 2D media, painting, graphics, painting, engraving, and others. Competition projects with image files – JPG and PNG with a width of up to 2000 pixels and a size of up to 5 MB are allowed.

(3)For selected competition projects that will become part of the exhibition, the format is vertical or horizontal images in size A1 (594 mm x 841 mm) or larger, in similar proportions.

(4)The competition focuses on the following areas:

  • Ecological ecosystem – illustrating rivers as vital ecological corridors, nourishing biodiversity, and providing essential resources for urban life. The goal is to capture the life-giving essence of rivers and show how rivers unite people and nature in common urban ecosystems.
  • Social and cultural rivers – emphasizing rivers as life arteries of cities, connecting communities and promoting social cohesion. The aim is to show how rivers serve as public spaces for gathering, relaxation, and cultural exchange, enriching urban life.
  • Historical significance – reflecting the historical transformation of rivers shaping the past and present landscapes of modern cities. The goal is to rediscover the past by exploring how rivers have evolved alongside urban environments, offering a glimpse into bygone eras.

(5) The focus of the Competition is not limited to paragraph 3, and participants can present other inspirations for their works, including the idea of beauty (or lack thereof) in and around rivers and their surroundings. Competition projects can highlight aspects of diverse flora and fauna found along the riverbanks and underwater, as well as improving biodiversity, public access, flood issues, and cultural preservation in their designs. Posters can depict both actual conditions and desired transformations.

Article 4. (1) Participants submit their projects for participation in the Competition by uploading the project on the Competition’s page, along with information such as the participant’s name (author’s name if the participant is not the author), participant’s phone number, website address (if applicable), Instagram (if applicable), participant’s country, how you heard about the competition, whether you agree with the terms and conditions (including the clarification about intellectual property). An optional requirement for the competition project is the title of the work and a brief description of the work (up to 100 words). The competition projects sent by the participants are published by the Organizer’s editorial team on the Competition page on the website www.kolektiv.bg/competitions

(2) Simultaneously with sending the competition projects, participants send a message containing the data under Art. 17, para. 1 of these General Terms and Conditions, as well as the following text: “I confirm that I have read and agree with the General Terms and Conditions for participation in the Competition of ‘Rivers of the Future’ and the Rules for processing and protection of personal data of the Competition.”

(3) The right to participate in the Competition is activated with the opening of the invitation on June 14, 2024. The deadline for submitting competition projects is July 28, 2024. Voting for the Audience and Jury Award is from July 28 – August 11, 2024. The announcement of 12 selected works for the exhibition at the “Rivers of Sofia” festival is on August 12, 2024. The announcement of 24 selected works for the international online exhibition is on August 12, 2024. The exhibition at the “Rivers of Sofia” festival is from August 30 – September 1, 2024. The award ceremony is on August 31, 2024, Sofia, Bulgaria.

(4) The competition projects are evaluated by a jury consisting of: representatives of the Organizer (Martin Yankov – Collective Foundation and Antonia Dimitrova – Poiema Collective Foundation), Ana Georgieva – Marketing Manager, Visa, Zdravko Kozinc – Founder and Co-creator, Zavod Iskriva / Amazon of Europe andNatalia Stenimachiti – Public Diplomacy Office of the Embassy of Greece in Bulgaria / on behalf of the EUNIC (European Union National Institutes for Culture) Bulgaria.

(5) The jury evaluates the competition projects according to the following criteria:

  • relevance: how well the project reflects the theme of the Rivers of the Future
  • creativity: originality and expressiveness of the art
  • impact: emotional and intellectual impact on the viewer
  • technical skill: quality of execution and craftsmanship.

Article 5. (1)The Organizer of the Competition provides the following prizes for participation in the Competition:

  • Audience Award: €2000 and a trip to Sofia
  • Jury Award: €2000 and a trip to Sofia
  • Jury Runner-Up Award: €500 and a trip to Sofia

(2)Selected competition projects will be included in exhibitions:

  • 12 competition projects will become part of an exhibition during the “Rivers of Sofia” 2024 festival in Sofia – the projects will be printed and exhibited during the “Rivers of Sofia” 2024 festival;
  • 24 competition projects will become part of an international online exhibition – the projects will be presented through an international communication campaign across Europe.

(3)The winners of the Audience Award, the Jury Award, and the Jury Runner-Up Award will receive paid plane tickets and accommodation to visit Sofia during the “Rivers of the City – Sofia” festival, where they will be publicly awarded at an official ceremony on August 31, 2024.

Article 6. (1) Participants agree to voluntarily participate in the Competition. No remuneration or compensation is due for participating in the Competition. Participants willingly accept all difficulties, risks, and inconveniences associated with their participation in the Competition and bear all costs and expenses related to their participation in the Competition and the fulfillment of their obligations under these General Terms and Conditions.

(2)Participation in the Competition does not bind the participant to win a prize or have their competition project included in an exhibition. Participants agree to follow the Organizer’s instructions in connection with their participation in the Competition and the fulfillment of their obligations under these General Terms and Conditions. The Organizer independently determines the rules for selecting participants who win the various prizes in the Competition. The decision to select a prize-winning participant is final and not subject to dispute or review. The participant acknowledges that even if included in the Competition, the Organizer is not obliged to conduct the Competition and/or announce a winner in the Competition.

Article 7. Participants must provide accurate and truthful personal data, information, and declarations (where required) for their participation in the Contest. If the provided personal data, information, or declarations are false and/or the participant fails to comply with any of the clauses of these General Terms and Conditions, the Organizer has the right to disqualify/remove the participant from the Contest and/or from any prize in the Contest, if applicable.

Article 8. The Organizer has the right to make public statements, explanations, and announcements as deemed appropriate regarding the compliance or non-compliance with the General Terms and Conditions by the participants and/or the regulations and rules of the Contest.

III. Transfer of Rights for Use of Protected Objects under the Copyright and Related Rights Act (CRRA) in favor of the Company

Article 9.(1) As part of the conditions for participation in the Contest, the participant publishes or provides for publication on the site one or more works – contest projects with specific author content.

(2) By accepting these General Terms and Conditions and by the act of submitting/providing the contest project, participants agree and transfer to the Organizer and the partner Visa all property and transferable non-property copyright rights over the published contest project, as well as the exclusive right for the Organizer and the partner Visa to use the projects repeatedly in all ways provided in the Copyright and Related Rights Act (CRRA), for the maximum allowable period defined by the CRRA and for the entire world.

(3) Usage, within the meaning of the previous paragraph, includes, without being limited to: recording, reproduction, distribution, wireless broadcasting, cable transmission and retransmission by other organizations and via other electronic communication networks, publishing, including on the Internet (e.g., websites and social networks), offering wireless or cable access to an unlimited number of people to the photos or parts of them in a manner that allows such access to be made from a place and at a time individually chosen by each of them, public display, modification or use in any other way for analog and digital distribution, distribution via mobile content transfer networks, via the internet and other distribution platforms and via any other technical means or forms of digital content distribution, existing now or created or arising later, import and export, storage in the archive and database of the site, as well as transferring the rights for use under this paragraph to third parties.

(4) Depending on the nature of the usage and at the discretion of the Organizer and/or the partner Visa, the author may be explicitly indicated when a specific work is used. No remuneration is due to the participant for the use of the contest projects by the Organizer and the partner Visa under these rules and in any way in the Contest. By participating in the Contest, the participant gains the opportunity to promote their work through the Organizer’s site and the Contest page within the scope and under the conditions of the Contest and these General Terms and Conditions.

Article 10. (1) The participant undertakes, declares, and guarantees that:

  • They are the author of the contest project or have received the author’s consent for its publication on the site and the contest participation page in accordance with these General Terms and Conditions, and that the author has given their consent to transfer the rights to the Organizer as outlined in this article. The participant undertakes to specify the author of the work in the contest project to the Organizer if it is a third party different from the participant;
  • The work does not contain violence, humiliation of human dignity, does not in any way affect personal privacy, privacy of personal or family life of any person, does not infringe on the rights and good name of others;
  • The work does not contain pornographic content;
  • The work does not contain religious offense and does not contain religious and/or political agitation;
  • The work does not infringe the rights and legitimate interests of third parties, including copyright, dignity, public reputation, good name, and others;
  • The work does not incite hatred based on racial, gender, religious, or national grounds and does not contain any form of discrimination or abuse of trust;
  • The work does not endanger the physical, mental, or moral development of minors;
  • The use of the work and its content does not violate applicable laws, these General Terms and Conditions, moral rules, or good manners;
  • The work does not contain advertising materials or messages.

(2) In case of violation of this provision, the participant assumes all responsibility at their own expense and pays the compensation imposed by the competent authority to the affected parties, fines and property sanctions, and any amounts that the Organizer and/or the partner Visa may be obliged or have agreed to pay as compensation or remuneration to a third party, as well as all damages and expenses incurred for the Organizer and/or the partner Visa.

(3) At the discretion of the Organizer, any contest project may be removed from the site and the contest page.

(4) All participations of the participant in advertising materials (including commercials, sponsor logos, and other advertising forms) in any way related to the Contest or the participant’s participation in it, as well as all participations of the participant as an advertising figure in an image that may be associated with the participant’s status in the Contest, are arranged only with the prior consent of the Organizer and with the participation of the Organizer.

IV. Participation Rules

Article 11. By accepting these General Terms and Conditions, the participant declares that there is no contract or other agreement between them and a third party, or any other circumstance that would prevent the fulfillment of these General Terms and Conditions, and that they will not undertake any obligations that would impede their fulfillment.

Article 12. Each participant in the Contest is obliged not to damage the good name of the Organizer, and not to hinder or stop in any way the conduct of the Contest, its promotion, or advertising.

Article 13. (1) Each participant has the right to request information from the Organizer about the Contest and the conditions for its conduct.
(2) Each participant has the right to notify the Organizer of any issues they have identified related to the use of the site or page (including detected errors, technical difficulties, violated rights, etc.) and other technical difficulties in participating in the Contest.
(3) Each participant has the right to withdraw from the Contest with a written statement addressed to the Organizer. The withdrawal from participation has a forward-looking effect and does not affect the legality of the actions taken by the Organizer up to the date of the withdrawal.

Article 14. (1) When using the site or the page for the purposes of the Contest, participants are obliged not to violate the rights and interests of the Organizer and third parties and not to perform malicious actions.
(2) “Malicious actions” within the meaning of these General Terms and Conditions are actions or omissions leading to the unauthorized use or modification of the Contest page “Rivers of the Future” or the site www.kolektiv.bg/competitions  and/or the content of the site or page. Malicious actions can include, without being exhaustive, content modification, publishing materials on the site, unauthorized information retrieval, protection disruption or malicious use of system weaknesses and flaws (HACK), damaging or destroying systems or data arrays, functions and characteristics of the site’s software (CRACK), sending “Trojan horses” or causing the installation of viruses or remote control systems, sending unsolicited mail, overloading channels, bypassing, damaging or otherwise disrupting the normal operation of technical or software applications, and any other actions that disrupt the normal functioning of the site and the ability of other users to use the site, as well as any actions that can be qualified as violations under Bulgarian law.
(3) Participants are obliged not to perform any actions that could lead to the manipulation of the voting or the voting results of the Contest or to hinder its conduct. In case the Organizer suspects manipulation of the voting or the voting results, the Organizer has the right to terminate the participation in the Contest of the participant suspected, as well as to deprive them of any prize won from the Contest.

Article 15. Each participant is responsible in case of violation of these General Terms and Conditions and any violation of applicable law when using the site or page and their content and when participating in the Contest and is obliged to compensate the Organizer for all damages – suffered losses and lost profits, resulting from the violation, including paid property sanctions, attorney fees, and other expenses, as a result of claims made by and/or paid compensations or remunerations to third parties.

V. Personal Data Protection

Article 16. (1) For the purpose of participating in the Contest, each participant voluntarily provides the Organizer with the following personal data: a) Participant data: first name, last name, age, place of residence, country, phone number, website address, Instagram profile, email address, and others; b) Data of parents/guardians of participants under the age of 18: first and last name of the person giving consent, as well as their relationship to the participant (parent or guardian).
(2) The Organizer (with identification details in accordance with Article 1 of the General Terms and Conditions) acts as the administrator of the personal data specified in paragraph 1 of this article.
(3) The personal data specified in paragraph 1 will be processed (used) by the Organizer for the purpose of conducting the “Rivers of the Future” Contest.

Article 17. The provision of personal data is done voluntarily by the participants based on the contractual relationship between the Organizer and the participant, regulated by these General Terms and Conditions. If a participant does not provide their personal data or part of it, this may lead to the inability to participate in the Contest.

VI. Limitation of Liability

Article 18. (1) The content of the website  www.kolektiv.bg/competitions  and changes to it are determined entirely at the discretion of the Organizer. The Organizer has the right to publish informational materials and commercial communications on the site, including materials and commercial communications of third parties, as well as to associate commercial communications of third parties and the Organizer with the Contest.
(2)
As far as permissible under the applicable rules, the use of the page, the content of the Contest page, and changes to it are entirely determined by the Organizer. The rules of the Contest are entirely at the discretion of the Organizer.

Article 19. (1) The Organizer and/or partner Visa are not liable for:

  • the inability to access the website kolektiv.bg/competitions or disruptions in the functioning of the site, including for technical reasons, as a result of tests by the Organizer on the technical resources and software, connections, networks, and others, as well as any other checks or work on the site aimed at improving or redesigning the site and/or its content;
  • the functioning of the internet network and the Contest page and the connectivity with the end-user devices of the users and participants;
  • the possible presence of “viruses” or other harmful consequences from using the site;
  • malicious actions by a user, participant, or third party; other circumstances beyond the control of the Organizer. Beyond the control of the Organizer is any action or inaction by a user or third party, unavailability or improper functioning of internet connectivity, or any other reason leading to degraded quality or inability to use the sites or page without disturbance, including, but not limited to, improper handling of equipment and devices by a user or third party, failure to fulfill an obligation by a third party or user concerning the use of the site, force majeure circumstances, and others.

(2) The Organizer and/or partner Visa are not liable for damages caused to the software, hardware, or equipment of the user, or for loss of data resulting from materials or resources searched, loaded, or used in any way through the services provided on the site or page.

The Organizer and/or partner Visa are not liable to participants and users of the site or page for suffered damages and lost profits resulting from the termination, suspension, restriction of access, or modification of the site www… or the Contest page, or the resources or services of the site, or from the deletion, alteration, loss of materials or information available through the site or page.
(4) The Organizer and/or partner Visa are not liable to participants when realizing the prizes related to travel to Sofia – for delays/cancellations of flights, for additional flight-related expenses, such as airport taxes, insurance, extra baggage, priority check-in, or use of additional amenities during the flight, for accidents or damages during the flight, for additional accommodation expenses and personal needs.

VII. Miscellaneous

Article 20. If any clause of these General Terms and Conditions is found to be invalid, this will not entail the invalidity of these General Terms and Conditions. The invalid clause will be replaced by mandatory provisions of the law or established practice.

Article 21. For all matters not settled by this contract, the provisions of the current legislation of the Republic of Bulgaria shall apply.

Article 22. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. If no agreement is reached, all unresolved disputes arising from the application of these General Terms and Conditions, including those regarding their interpretation, invalidity, and performance, will be resolved by the competent court under the applicable Bulgarian legislation in Sofia.

Article 25. These General Terms and Conditions are effective from June 14, 2024.
