Article 1. (1) These Personal Data Privacy Rules regulate the relationship between the Kolektiv Foundation, UIC 206066308, with its seat and management address: Sofia, Lyulin District, Lyulin 7, Bl. 724, Ent. B, Fl. 1, Ap. 3, in collaboration with the Poiema Collective Foundation, UIC 206275795, with its seat and management address: Sofia, Triaditsa District, Gotse Delchev, Bl. 235, Ent. B, Fl. 3, Ap. 27 (hereinafter referred to as the “Organizer”) and the participants in the “Rivers of the Future” contest (hereinafter referred to as the “Contest”), regarding the personal data of the participants in the “Rivers of the Future” Contest, which become known to the Organizer and/or its partners in organizing and conducting the Contest, including but not limited to representatives, authorized persons, employees, jury members, lawyers, notaries, consultants, and others.
(2) By virtue of these personal data privacy rules, the Organizer and its partners in the contest adhere to all established regulations and rules for the collection, storage, protection, and dissemination of these data. All activities related to the collection, storage, protection, and dissemination of personal data are carried out in accordance with the applicable Bulgarian and European legislation, ensuring maximum care and implementing security measures to prevent the infringement of the participants’ rights in the Contest.
Article 2. (1) In view of their participation in the Contest, each participant voluntarily provides the Organizer with the following personal data: a) participant data: name, surname, age, place of residence, country, phone number, website address, Instagram profile, email address, and others; b) data of parents/guardians/custodians of participants under the age of 18: name and surname of the consenting person, as well as their relationship to the participant (parent or guardian).
(2) In addition to the mentioned personal data, the scope of the collected personal data also includes the following technical data: a) data about the used electronic communication device; b) type of device; c) used operating system, IP address, location; d) data obtained from inquiries on the website.
(3) The Organizer (with identification data according to Art. 1 of these Personal Data Privacy Rules) acts as the administrator of the personal data of the participant specified in paragraph 1 of this article. The Organizer designates the following data protection officer: M. Yankov, email: competitions@kolektiv.bg.
Article 3. The provision of personal data is voluntary for the participants based on the contractual relationship between the Organizer and the participant, regulated by the General Terms of Participation in the Contest. If a participant does not provide their personal data or part of it, this may lead to the impossibility of their participation in the Contest.
Article 4. (1) Every participant in the Contest, who has provided their personal data, has the right to access their data stored by the Organizer and/or its partners in the Contest. The right of access is exercised through a written request addressed to the Organizer at the following email address: competitions@kolektiv.bg.
(2) In addition to the right of access, each participant in the Contest has the right to request: a) correction of their provided personal data; b) deletion of their provided personal data with all resulting legal consequences depending on the stage of the Contest; c) restricted processing of their provided personal data for a certain period with all resulting legal consequences depending on the stage of the Contest; d) objection to the processing of their provided personal data with all resulting legal consequences depending on the stage of the Contest and other rights in accordance with the applicable legislation.
(3) In certain cases, to comply with legal provisions and rules, some of the aforementioned requests may not be honored by the Organizer. Each participant can contact the data protection officer of the Organizer for additional questions and clarifications on this topic at the following email address: competitions@kolektiv.bg.
(4) When providing access to personal data, as well as when making additional requests regarding the provided personal data, to protect the rights of the participants in the Contest and all other individuals, the Organizer and/or its partners in the Contest have the right to verify the identity of the requester by requesting additional information or actions (e.g., in-person verification, signing with a qualified electronic signature, or others), as well as applying other reasonable measures for indisputable identification, depending on the request, nature of the data, and context of their processing.
Article 5. Additional protection measures are taken when providing personal data of minors. Participation in the Contest by individuals under 18 years requires additional consent from a parent or guardian. For participation in the Contest by individuals under 14 years, the provision of personal and other data must be done solely by a parent or guardian. Any application created by an individual under the age of 14 without parental/guardian permission must be deleted by the Organizer upon obtaining such information.
Article 6. The personal data provided by participants in the Contest may be disclosed to third parties in the following cases: 6.1 when there is a legal obligation to disclose such information and upon request by competent persons and institutions (law enforcement agencies, executive authorities, governmental and regulatory agencies, or other third parties, as required by and in accordance with applicable law); 6.2 upon a court order to provide personal data in accordance with a presented court certificate to this effect; 6.3 to third-party providers who offer applications/functionality, IT services, or data processing services; who assist the Organizer and/or its partners in the Contest in providing the respective services, as well as assist in the provision and management of IT systems (IT service providers, cloud service providers, identity management, website hosting and management, data analysis, data archiving, security, and storage services – the servers that support this cloud infrastructure are located in secure data centers around the world and personal data may be stored in any of them); 6.4 to third parties who assist the Organizer and/or its partners in the Contest in providing goods, services, or information; 6.7 to experts and other professional consultants.
Article 7. (1) In case of infringement of the rights of a participant in the Contest, the participant may file a complaint with the data protection officer of the Organizer and/or its partners in the Contest at the following email address: competitions@kolektiv.bg. All submitted complaints will be reviewed promptly, and the complainant will be informed of the data protection officer’s opinion.
(2) In case of infringement of the rights of a participant in the Contest, the participant may also file a complaint with the Commission for Personal Data Protection: Sofia 1592, 2 Prof. Tsvetan Lazarov Blvd., phone: 02 915 3 518, website: www.cpdp.bg.
Article 8. These Personal Data Privacy Rules are effective from June 14, 2024.
